In today's Plain Dealer, Professor Steven H. Steinglass discusses the issues under the Ohio Constitution created by S.B. 82, the Ohio Act outlawing residency requirements for city workers. While this statute probably violates a city's right to self govern under the Home Rule amendment, Article 18, Section 3, the State may have the power to make the statute under the amendment allowing the State to pass employee welfare laws, Article II, Section 34. The major precedent in determining whether the home rule amendment or employee welfare amendment prevails is Rocky River v. State Employment Relations Board (1989), 43 Ohio St.3d 1.
