The Ohio Court of Appeals, Third District held that the domestic violence statute violates the Ohio Constitution, because of the recent "defense of marriage" constitutional amendment. State v. Shaffer , 3rd Dist. No. 14-05-55, 2006-Ohio-2662. The appellate districts are in conflict on this issue. The Ohio Supreme Court agreed to hear an appeal of a 12th District case finding that the domestic violence statute is constitutional. See State v. Carswell, Ohio Supreme Court Case No. 2006-0151.
