Affidavit Under Seal Satisfies Fourth Amendment

In Baranski v. Fifteen Unknown Agents of the ATF, 03-5582 (6th Cir., July 3, 2006), an en banc panel held that an affidavit kept under seal satisfies the Fourth Amendment’s requirement that search warrant must describe with particularity the items to be seized.  See En Banc Sixth Circuit Divides over Particularity Requirement of Fourth Amendment by Robert Loblaw, Decision of the Day Blog, 7-3-06.
