Yesterday, the 8th District Court of Appeals refused to grant prosecutors in the Holliman case a stay of Common Pleas Judge Eileen Gallagher's order requiring the prosecutors to turn over virtually their entire investigatory file to the defense. A newsnet5.com article on the Court's order indicates that the order does not contain the court's reasoning, and states that but for 7 pages of notes, some case law and a folder with victim statements, the Judge has already allowed defense attorneys to sift through a box of evidence under the watchful eye of her staff. See our prior post on Judge Gallagher's order, the current laws on discovery in criminal cases, and information on accessing the docket in the case.
